Disclaimer 1 (eligibility and how to win):
Follow the Resort socials on event day to receive clues as to where the flags are hidden around the mountain. The first individual to find a flag in its hidden location and take it to a participating shop on mountain on the day of the event wins a Subaru Wilderness prize pack. An individual may only redeem one (1) flag across all contest venues. The Contest is open only to Australian residents aged eighteen (18) years or older at the time of entry. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for the Sponsor, its licensees, and/or their respective parent, subsidiary, affiliated and successor companies and "immediate family members" and "household members" of such individuals, are not eligible to enter the Contest or win a prize. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Potential winners may be required to provide proof of Australian residency upon request prior to prize award. Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate. By entering this Contest or accepting a prize, all entrants agree that to the fullest extent permissible by law, the entrants shall release, discharge, and hold harmless Subaru (Aust) Pty Ltd, its employees, officers, directors, agents and representatives from any and all liability, claims, losses and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder, including, without limitation, all liability for injuries, including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death or disability), property damage, or loss or damage of any other kind arising in whole or in part, directly or indirectly, from delivery/non-delivery, acceptance, use or misuse of the prize or from participation in this Contest or any Contest-related activity. Nothing in these terms and conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.
